1. Who we are

GoTender ("the Platform") is an online marketplace intermediary that connects independent local sellers — shops, service providers, hotels and food businesses — with customers near them. GoTender is not the seller of record for products or services listed on the Platform. In India, GoTender operates as an "e-commerce entity" of the marketplace model under the Consumer Protection (E-Commerce) Rules, 2020 and as an "intermediary" under the Information Technology Act, 2000.

2. Accounts

  • You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account.
  • You are responsible for keeping your login credentials confidential and for all activity under your account.
  • Information you provide must be true, accurate and kept up to date.

3. Role of GoTender

  • The contract of sale for any product or service is directly between the customer and the seller.
  • GoTender provides discovery (including distance-based search), catalogue, ordering and communication tools.
  • GoTender does not own, stock, inspect or deliver seller inventory and does not guarantee seller performance, though we act on complaints per our grievance process.

4. Customer obligations

  • Place orders in good faith and be available to receive/pay for cash-on-delivery orders you place.
  • Do not misuse reviews; only review sellers after a genuine delivered order.
  • Comply with the laws applicable to any purchase (e.g. age-restricted goods where permitted).

5. Seller obligations

Sellers must additionally comply with the Seller Agreement, hold all licenses required for their trade (e.g. GST registration, FSSAI license for food in India, local trade licenses), list accurate prices inclusive of mandatory charges, honour orders and applicable warranties, and comply with consumer-protection, tax, labelling and safety laws of every jurisdiction where they sell.

6. Prohibited items and conduct

  • Illegal goods or services, counterfeit goods, weapons, drugs, wildlife products and any item restricted by applicable law.
  • Misleading listings, fake reviews, price manipulation and any deceptive trade practice.
  • Infringement of intellectual-property rights.

7. Payments

Payments are currently settled directly between customer and seller (cash on delivery or direct UPI/bank transfer). GoTender does not hold customer funds. Where an online payment gateway is offered in future, its terms will apply in addition.

8. Liability

To the maximum extent permitted by law, GoTender's liability as an intermediary is limited. Nothing in these terms limits rights that cannot be waived under consumer law, including your rights under the (Indian) Consumer Protection Act, 2019 or equivalent local law.

9. Governing law & disputes

For users in India these terms are governed by Indian law, and consumer disputes may be raised before the appropriate Consumer Commission in addition to our internal grievance process. For users elsewhere, mandatory local consumer law prevails.

10. Changes

We may update these terms; material changes will be notified on the Platform. Continued use constitutes acceptance.
